Santos v. Ohio Bureau of Workers' Compensation, Cuyahoga C.P. Case No. 393694.

This class action lawsuit produced a judgment ordering the Ohio Bureau of Workers Compensation to return approximately $52,000,000.00 in subrogation payments that were collected from roughly 8,000 injured workers under the authority of an unconstitutional statute, R.C. §4131.931.  The lawsuit was original filed in Cuyahoga County Court of Common Pleas in October 1999 and took nearly seven years to conclude.  Two appeals, including one trip to the Ohio Supreme Court Court, were necessary.
